1. Definitions
Weigh To Know means Weigh To Know Pty Ltd (‘we, us, our’)
Client means the person or entity booking or receiving the service from Weigh To Know (‘client, you, your’).
2. Acceptance of Terms and Conditions
By engaging Weigh To Know to weigh your caravan, vehicle or trailer (‘vehicle’), the client acknowledges and agrees the following terms and conditions.
3. Scope of Service
Our service is limited to determining the weight of the vehicle at the time and place of weighing. We do not perform mechanical inspections, roadworthy assessments, or any form of legal or professional compliance. The information contained in the report provided reflects measurements taken at the date and time of weighing and is true and correct to the best of our knowledge based on the conditions present at that time.
4. The Report – Informational purposes only
The report we provide to you is strictly for informational purposes only and does not constitute professional advice, certification, legal compliance confirmation, engineering advice, or verification of compliance with any manufacturer specifications, legislation, or regulatory requirements. Conditions, loading configurations, and vehicle modifications may change at any time and may affect weights and compliance outcomes. You are solely responsible for ensuring your vehicle and load complies with all applicable laws, regulations and manufacturer requirements. The informational report will be provided to you upon payment in full of our invoice. The report must not be reproduced or distributed to any third party.
5. Accuracy of Measurement
While reasonable care is taken, and we strive to maintain calibrated equipment and accurate procedures; various factors may affect the accuracy of the measurements. Measurements are subject to tolerances inherent in mobile testing and environmental conditions.
6. Bookings and payment
Bookings are confirmed upon payment of the applicable costs (if requested). Full payment is due at the time of the service. Travel surcharges may apply outside designated service areas.
7. Cancellations and rescheduling
Cancellations made more than 24 hours before the scheduled service may receive a full refund. Cancellations made within 24 hours before the scheduled service or failure to attend may result in forfeiture of the full costs. We reserve the right to reschedule due to weather, safety concerns or other unforeseen circumstances.
8. Safety
You are reasonable for operating your vehicle in a safe manner and following all relevant road rules and directions by Weigh To Know when using our equipment.
9. Limitation of Liability
To the maximum extent permitted by law, Weigh To Know excludes all liability for any loss, damage, injury, claim, cost, or expense (including indirect or consequential loss) arising from using our services or in connection with the use of, interpretation of, or reliance upon the report or the information contained within it. You fully accept responsibility for ensuring your vehicle, trailer, and load comply with all applicable laws, regulations, and manufacturer requirements. We exclude all liability for fines, penalties or regulatory enforcement arising from vehicle overloading.
10. No warranties
We make no warranty, express or implied, regarding the completeness, accuracy, or reliability of the information provided.
11. Exclusion of Damages
To the maximum extent permitted by law, Weigh To Know shall not be liable for any damages, losses, costs, or liabilities (including, but not limited to, direct, indirect, punitive, incidental, or consequential damages) arising out of or related to the use of, or reliance on, our weighing services or the report. This includes, but is not limited to, damage to vehicles, property, third parties or injuries to individuals.
12. Indemnity
You agree to indemnify Weigh To Know, its officers, employees and agents from and against any claims, damages, losses or expenses whatsoever arising from carrying out our services and the report whether to person or property (including the vehicle) arising from default, negligence, misconduct or otherwise by us, our employees and agents.
13. Use of Images
We may collect images, data, or other records for internal documentation and service verification. You agree that we may use images and data for marketing, training, and research purposes. We will not disclose personal contact information without your explicit consent.
14. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales.
15. Amendments and Updates
Weigh To Know reserves the right to vary or amend these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting the updated terms on our website or otherwise notifying clients. Your continued use of our services after any such updates constitutes acceptance of the revised terms.
